NYLVI Guidelines
NYLVI is a marketplace for buying and selling vinyl records. Our mission is to support independent artists, labels and record stores, by helping them to spread musical innovation to a global community of music lovers and record collectors. NYLVI wants to build a community around the act of buying and selling vinyl records.
We want everyone to have a good time at NYLVI and we believe the easiest way to achieve this is to have some guidelines for member behavior. So please read this page with care, as it explains the guidelines for being a member of the NYLVI community. If you still have questions after reading these policies, please check out our Help section or feel free to contact us.
1. NYLVI Membership
Remember that your username on NYLVI is your identity. You are responsible for your conduct and all content submitted under your username on NYLVI.
1. By joining NYLVI, all members agree to abide by the policies outlined here and in the Terms of Use.
2. You must be at least 18 years of age to hold an account on NYLVI. If you are under 18, you must have the permission and supervision of a parent or legal guardian who is at least 18 years of age; that adult is responsible for the account.
3. You may not use racist or otherwise offensive language or images in your username, avatar or profile.
4. You may not transfer ownership or sell your NYLVI account to another party.
5. Usernames cannot be changed except in the event of documented legal action (such as trademark infringement) at NYLVI's discretion. Choose your username carefully.
6. A NYLVI account cannot be used for the sole purpose of redirecting traffic to another web location, even if it is another NYLVI account. Please contact to have your account closed if you are no longer using it.
7. Keep your account information updated and accurate. Your account must have a valid email address at all times. NYLVI will use the email address on file in your account information to contact you when necessary.
8. NYLVI encourages all members to resolve their own disputes. As a venue, NYLVI cannot mediate disputes between members or other parties.
Breaking any of NYLVI's policies may result in suspension of account privileges and/or account termination.
2. Buying & Selling
NYLVI's role is to connect the buyer and the seller; we are a venue, not a vendor. This means when you place an order on NYLVI, you are entering into a direct transaction and personal relationship with an individual seller (facilitated by NYLVI).
Feedback
Feedback is a way to establish a reputation of trust for both buyers and sellers. For every transaction, the buyer and seller have the opportunity to rate the transaction on a scale from one to five and write an optional comment. Consistency, fairness and honesty are critical to the integrity of the feedback system. Members are encouraged to use the feedback system. Feedback directly affects a member's reputation as a buyer or seller, so please take it seriously.
Buying
All sellers post important information, such as policies, public profile, shipping policies, return & refund policies on their store pages. Before buying you should read all feedback about the seller and look at their statistics.
When you purchase an item on NYLVI, you agree to pay the seller for the item. Do not purchase items for which you do not intend to pay.
The buyer must send payment directly to the seller (not to NYLVI).
It is the buyer's responsibility to pay the seller.
Selling
NYLVI is a marketplace for independent artists, labels and record stores and record collectors to sell music on vinyl.
Setting up a shop
All sellers must provide information about shipping prices and policies, backorder policies, return and refund policies and payment options on their shop page. We also encourage all sellers to explain your general shop policies on your shop policies page and to provide information about your shop in your public profile.
Please keep the following things in mind as you set up your shop and upload inventory:
* An individual shop's policies must not contradict NYLVI's site-wide policies. NYLVI reserves the right to ask sellers to modify unreasonable policies at NYLVI's discretion.
* You may not post links/URLs to other venues where you have the same items for sale that are listed in your NYLVI shop.
* Do not make illegal use of photographs or written text, as this is in violation of NYLVI's Terms of Use. Contact the owner and ask permission.
* Use of offensive and/or racist language or images in the public areas of your NYLVI shop is not permitted. This includes your username, public profile, item titles, avatar, banner, announcement and/or shop sections.
* You must pay your bill on time to avoid penalties which include suspension of listing privileges and/or account termination.
* You may not use the public areas of your account to demonstrate or discuss disputes with others.
* You may not engage in any activity by which you avoid NYLVI's commission ("commission avoidance"). This includes but is not limited to: completing a transaction off-NYLVI once it has been initiated on the site, listing an item below its intended purchase price and canceling a completed transaction.
* You may only list vinyl records, other media types are not accepted at NYLVI. All types of vinyl is allowed.
* Records that are on backorder, must be clearly specified as such in your shop.
Inventory
The description should be clear and accurate. NYLVI also encourage sellers to add a detailed description to the records they sell.
Accurate titles, images and descriptions are a critical to selling on NYLVI. Accurate titles are very important, as NYLVI's search system relies on these to find your records for shoppers. Keep these policies in mind as you describe your records:
* Listing descriptions and iamges must clearly describe the item for sale so buyers know what they are buying.
* Only use accurate and relevant titles.
* The shipping price should be reasonable for the item.
* Grade your records honestly and in accordance with the Goldmine standard
NYLVI strongly encourage sellers to only list records they have in stock. It is permitted to sell records that is on backorder, but these must clearly be marked as such. It is important for NYLVI that buyers can know ahead of time if they will have to wait longer for a record because the seller needs to get the record in stock before it can be delivered to them.
NYLVI wants buyers to be able to safely assume that if a record is listed on NYLVI it is available for immediate purchase unless it is marked as on backorder. Sellers who do not follow this rule will be meet with sanctions as outlined in NYLVI's Terms of Use. Sellers must also declare their backorder policies on their shop page.
3. Scenes
The scene pages are an important part of NYLVI. On these pages we display sales statistics from relevant sources and we aggregate information and blog posts from local bloggers, who through their daily participation in the scenes are a great source for knowledge and updates on artists, releases, events and music related news.
It is of utmost importance for NYLVI to support and respect the artists, writers, editors and producers who create original content available on the Internet.
NYLVI's scene blog-aggregators provide full acknowledgment of the source and author for all content made available, additionally we also provide direct links back to the specific blogs where posts originated.
The blog-aggregators contain links to outside websites or resources. NYLVI is providing these links only as convenience to you. NYLVI does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources. We can't be responsible for what people post on their blogs, and we can't be responsible for what you do with it when you find it.
4. Community
The community section of NYLVI will be developed in close interaction with you, the user. All tips, suggestions and feedback are appreciated and will be used for further development of the community section and the service in general. Initial the community section will only feature Comment, the NYLVI blog, which is geared towards NYLVI members and readers interested in music in general and vinyl in particular. Announcements and site news are also published in Comment. It is written by NYLVI staff, special guests and members of NYLVI.
NYLVI wants the blog to be a place for communication and dialog between NYLVI and users and all constructive input, feedback and comments are appreciated.
However, to avoid spam and comments that are offensive or abusive, NYLVI reserves the right to remove blog comments.
The blog and it's posts will be available for re-posting with a few provisions
* Give credit where credit is due! Always cite the author(s) of the article.
* Link back to the original post; each post has a unique URL (web address).
* While NYLVI has permission to use content that our members post on www.NYLVI.com, our members do retain intellectual property rights for their work. Please respect the artist's rights if you are contacted by an individual about use of their copyrighted material.
